Terms of Use

1. The service

Vivaler is an app for discovering events in real time — nightlife, concerts, automotive, business & learning, gastronomy, shopping, social, and other categories — around you and in other cities, seeing live photos and comments posted by people on-site, and, for organizers, creating events and tracking their stats.

2. Minimum age and eligibility

You must be at least 16 to create a Vivaler account. By creating an account, you confirm you meet this requirement and that the information you provide is accurate.

3. Your account

You can browse as a guest (anonymous account) or create an account via phone number, email/password, Google, or Apple. You're responsible for keeping your credentials confidential and for any activity on your account. Let us know immediately at djesstsenda@gmail.com if you notice unauthorized access.

There are two account types: "individual" (to discover events) and "organizer" (to also create them). You choose your account type at sign-up.

4. Content you post

You keep ownership of the content you post (photos, comments, events you create). By posting it on Vivaler, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it within the app, solely to operate the service.

Photos posted at a live event are only allowed if you're physically present (verified by geolocation, within 500 meters of the event).

You agree to only post content you have the right to share, that is accurate, and that complies with these terms.

5. Prohibited conduct

You may not: post illegal, hateful, harassing, violent, or sexually explicit content; impersonate someone else; post false information about an event; circumvent the location-presence check; post unsolicited commercial content (spam); collect other users' data without authorization; disrupt the service (bots, scraping, reverse engineering); or use Vivaler for unlawful purposes.

6. Event organizers

If you create events, you're solely responsible for their accuracy, legality (permits, licenses, compliance with local regulations, including for alcohol sales where applicable), safety, and proper conduct. Vivaler is not the organizer of events listed on the platform and isn't responsible for what happens at them.

Statistics we provide (views, interested, comments, photos, shares) are given "as is", for informational purposes.

Boosting an event increases its visibility on the map according to the terms shown in the app at the time you purchase or use that feature.

7. Moderation and reporting

You can report an event, photo, or comment that violates these terms. We may, at our discretion, review, edit, hide, or remove any content, and suspend or delete an account that violates these terms, without notice in cases of serious violation.

8. Intellectual property

The "Vivaler" name, logo, and all elements of the app and website (excluding user-posted content) belong to us or are used under license. You may not reproduce or use them without our prior written permission.

9. Third-party services

The app relies on third-party services (Google Firebase, Google Maps Platform, Google Sign-In, Sign in with Apple) and lets you share content to third-party apps (Instagram, WhatsApp). Your use of those third-party services remains subject to their own terms.

10. No warranty and limitation of liability

Vivaler is provided "as is", with no guarantee of the accuracy of information posted by users or organizers, or of uninterrupted service availability. To the extent permitted by law, we're not liable for indirect damages arising from your participation in an event listed on the platform or your use of the app.

11. Suspension and account deletion

You can delete your account anytime from the app. We may suspend or delete an account for violating these terms, fraudulent activity, or at the request of a competent authority.

12. Changes

We may update these terms as Vivaler evolves. We'll flag significant changes in the app. Continuing to use Vivaler after a change means you accept the new terms.

13. Governing law

These terms are governed by Moroccan law. Any dispute will be subject to the competent courts, except where mandatory local consumer-protection law in your jurisdiction provides otherwise.
